1. Introduction
These Terms and Conditions (“Terms”) govern the relationship between Afghanistan On Tour Travel Agency (hereinafter referred to as “the Agency,” “we,” “our,” or “us”) and the customers (“you” or “the Customer”) booking tours with the Agency. By booking a tour with us, you agree to be bound by these Terms and Conditions. Please read them carefully before making a reservation.
2. Booking and Reservations
2.1 Tour Booking
To reserve a tour, you must submit a completed booking form through our website, email, or phone, along with the required deposit or full payment (depending on the terms of the tour package). A booking is considered confirmed once you receive a booking confirmation from us.
2.2 Tour Package Inclusions
The inclusions and exclusions of the tour package are detailed in the specific tour itinerary. These may include transport, meals, accommodations, local guides, activities, and entrance fees, as applicable.
2.3 Age and Eligibility Requirements
You must be at least 18 years old to book a tour. Minors must be accompanied by an adult. Some tours may have age restrictions, physical requirements, or specific health considerations, which will be outlined in the tour package details.
3. Payment Terms
3.1 Payment Structure
A deposit is typically required at the time of booking, with the balance due [X] days before the tour departure date. The deposit amount will be specified at the time of booking. If payment is not received by the due date, we reserve the right to cancel the booking.
3.2 Payment Methods
Payments can be made by credit card, bank transfer, or other methods specified by the Agency. All payments must be in the currency specified in the tour package.
3.3 Currency and Taxes
Tour prices are quoted in the US Dollar, and may be subject to change due to fluctuations in exchange rates, taxes, or fees imposed by authorities. Any such changes will be communicated to you promptly.
4. Cancellations and Refunds
4.1 Customer Cancellation
If you wish to cancel your booking, you must notify us in writing. The cancellation policy depends on when the cancellation is made relative to the tour start date:
- More than 30 days before departure: Full refund minus the deposit.
- 15-30 days before departure: 50% refund.
- Less than 15 days before departure: No refund.
4.2 Agency Cancellation
We reserve the right to cancel a tour due to unforeseen circumstances, including but not limited to security risks, natural disasters, or insufficient bookings. In such cases, a full refund will be issued, or an alternative tour may be offered.
4.3 No Show
If you fail to show up for the tour without prior cancellation, no refund will be provided.
5. Travel Insurance
We strongly recommend that you purchase travel insurance covering trip cancellation, medical emergencies, personal injury, lost luggage, and other unforeseen events. Travel insurance is not included in the tour price.
6. Changes to the Tour
6.1 Modifications by the Customer
If you wish to make changes to your booking, such as a change in travel dates or itinerary, we will do our best to accommodate your request, subject to availability and additional fees. Changes are subject to the Agency’s approval.
6.2 Modifications by the Agency
The Agency reserves the right to modify the tour itinerary or accommodations in response to unforeseen circumstances, such as weather conditions, safety concerns, or other operational challenges. We will make reasonable efforts to offer comparable alternatives.
7. Customer Responsibilities
7.1 Travel Documents
You are responsible for ensuring that you have all necessary travel documents, including but not limited to passports, visas, vaccinations, and any other entry requirements. The Agency will assist in providing necessary travel information, but the responsibility for obtaining required documents rests with you.
7.2 Health and Fitness
You must be in good health and capable of undertaking the tour activities. It is your responsibility to disclose any medical conditions or disabilities that could affect your participation. We may require a medical certificate for certain high-risk tours or activities.
7.3 Behavior and Conduct
You agree to conduct yourself in a manner that is respectful to other travelers, local communities, and guides. Any behavior deemed disruptive, unsafe, or illegal may result in immediate termination of your participation in the tour, with no refund provided.
8. Liability and Limitations
8.1 Personal Injury, Illness, and Loss
The Agency is not liable for any injury, illness, accident, loss, or damage to property arising from participation in the tour, including travel to and from Afghanistan. This includes any event caused by circumstances beyond our control, such as political unrest, natural disasters, or other unforeseeable events.
8.2 Force Majeure
The Agency will not be held liable for failure to perform its obligations due to force majeure events, including but not limited to war, terrorism, strikes, natural disasters, or government restrictions.
8.3 Third-Party Services
The Agency may use third-party suppliers for accommodations, transport, and other services. We will make every effort to ensure these services meet our quality standards, but the Agency is not liable for any failure on the part of third-party suppliers.
9. Photography and Media
9.1 Consent to Photography
During the tour, you may be photographed or filmed. By participating in the tour, you consent to the use of these photographs or videos for marketing purposes, unless you specifically opt out in writing before the tour begins.
10. Privacy and Data Protection
10.1 Data Collection
We collect personal information such as your name, contact details, and payment information in order to process your booking and provide customer service. Your information will be handled in accordance with applicable privacy laws and will not be shared with third parties without your consent.
10.2 Security
We use reasonable efforts to protect your personal data from unauthorized access, alteration, or destruction, but cannot guarantee complete security.
11. Dispute Resolution
11.1 Governing Law
These Terms and Conditions will be governed by the laws of Afghanistan. Any dispute arising from these terms shall be subject to the jurisdiction of the Afghan courts.
11.2 Resolution of Disputes
In the event of a dispute, we encourage customers to first contact us directly. If a resolution cannot be reached, the dispute may be referred to arbitration or mediation as per the laws governing consumer disputes in Afghanistan.
12. Miscellaneous
12.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms shall remain in full force and effect.
12.2 Amendments
We reserve the right to amend these Terms at any time. All changes will be posted on our website and will be effective immediately upon publication.
12.3 Entire Agreement
These Terms and Conditions represent the entire agreement between the Agency and the Customer. Any prior agreements, representations, or understandings, whether oral or written, are superseded by this document.
